課程概述 |
法知識論(Epistemology of Law; Erkenntnistheorie des Rechts)為法理學的重要研究領域，如同一般哲學的知識論探討知識的形成與證立的條件，法知識論主要探討法律知識的成立條件以及法律命題的證立條件，依其重點與問題性的不同，可以體現為法詮釋學(legal hermeneutics)、法學方法論(Methodenlehre der Rechtawissenschaft)或法論證理論(theory of legal argumentation)，探究法律的解釋規則、解釋原則、解釋理論、法解釋的客觀性以及法論證正當化的條件等議題，在學科層面則形成法學的科學理論(Rechtswissenschaftstheorie)，探究法學的科學性質、法學的多元類型、法學內部學科的整合(intradisciplinarity)、法學與其他科學的科際整合 (interdisciplinarity)等議題。由於哲學詮釋學探討理解與解釋能夠成立的一般條件，因此就形成法詮釋學的理論或哲學基礎，本學期課程打算以哲學詮釋學為探討重點，並以Friedrich D. E. Schleiermacher, Wilhelm Dilthey, Martin Heidegger, Hans-Georg Gadamer與Emilio Betti的經典文獻為閱讀與討論的內容。並以此經典為理解背景，考察德國法學界尤其是法學方法論在1960年之後以及美國法學界在1970年之後，對於Hans-Georg Gadamer哲學詮釋學的繼受暨其進一步的發展。 |

課程目標 |
本課程作為專題研究，授課對象為高年級以及研究所學生，屬於介於大學部與研究所之間的課程，課程目標具有雙重性，首先是基礎性的，著重於引介與討論法知識論與法學方法論的基本概念、研究課題與理論取向，提供學生對此課題的一般性理解，以作為未來進一步研究的基礎，其次則是進階性的，著重培養學生的研究法知識論的學術潛能，因此將採取原典短篇導讀或小型專題報告的方式來進行。 |

課程要求 |
1. 強烈的學習動機與求知慾，參與討論的心理準備，基本的英文閱讀能力，基本的法學經驗。由於有部分文獻只有德文版本，歡迎具有基本德文閱讀能力的同學加入。
2. 缺席（含請假）請勿超過三次
